standard (single Sale) License

this license includes the basic usage rights, rules, & restrictions that come with every design purchase. These terms and conditions that MUST be followed. Please read below for important license terms definitions, permitted usages, and restrictions for ALL designs purchased from drypdesigns. Violations will result in disputes being filed against you as an intellectual property thief/violator by us (drypdesigns).

License Term Definitions.

“Item” — Defined as digital files produced by drypdesigns such as graphics, digital papers, backgrounds, patterns, textures, mockups, templates, and/or a combination of any such design elements downloadable from drypdesigns website and other affiliated marketplaces.

“Personal Use” — Defined as using Items in a manner that (i) does not generate any monetary gain to Yourself or any Third Party; (ii) is not meant to entice sales; and (iii) is not used in premises, platform or event which is related to any business, community or non-profit organizational purposes.

“Commercial Use” — Defined as using Items in a manner that would result in or is intended for receiving any form of monetary gain (payment) procuring sales, or commercial exposure for Yourself, Your client, or any Third Party. This includes any other usages which do not fall under Personal Use.

What’s Allowed & what’s not allowed

  • You may NOT modify, reproduce, distribute, or resell the Item in ANY digital format (SVG, PNG, JPG, etc)

  • You may NOT sublicense, rent, lent, assign, gift, transfer, distribute, or grant rights to Items in ANY way

    • You may NOT redistribute/share/exchange or sell to End Consumer unmodified by itself.

    • You may NOT redistribute/share/exchange or sell in a digital products bundle.

    • You may NOT redistribute/share/exchange for free or as a gift

  • You may NOT claim the design as your own, the copyright remains with drypdesigns.

  • You MAY use Item "As-Is" for Personal Use

    • “Personal Use” - defined above

You MAY use Items for End Products (Commercial Use) RESTRICTIONS APPLY

  • You may NOT upload the design “As Is” on Print on Demand sites

    • ex. Redbubble, Teespring, Teepublic, Society6, Etsy, Zazzle, Merch by Amazon, etc.

  • You may NOT place Items onto an object “As Is” and then resold for profit as a digital/physical End Product; You MUST recreate the Item into a new derivative work by combining and/or using with another font(s) or design element(s) to create a distinctive new design as a flattened End Product, that does NOT resemble or compete with the original Item used. (examples shown below)

    • End Products MAY NOT be used or sold in a way that is directly competitive with drypdesigns brands

    • End Products MUST be in an outlined/flattened file format so that the original Item cannot be extracted or separated from the final end design.

    • REMINDER: there are other third parties who use the same Item, therefore You MUST ensure End Products are as unique as possible to avoid competition or being accused of violating these terms

  • You are NOT allowed to register the Items or End Products incorporating the Items (i.e. logo design, brand symbol) as trademark in any territory. You are only licensed with non-exclusive rights to use the Items, therefore the same Items may be used by other parties as well.

 OTHER IMPORTANT INFORMATION:

  • By purchasing any designs you are agreeing to these terms.

  • drypdesigns reserves the right to modify, update, and change our Terms of Use and Licensing Terms at any time, with or without notice.
